Upon consideration of the petition submitted by the Disciplinary Board of the Hawai’i Supreme Court for an order granting the request of attorney John S. Carroll to resign from the practice of law in lieu of discipline, and the affidavit attached in support thereof, we find Respondent Carroll’s affidavit meets the requirements of Rule 2.14(a) of the Rules of the Supreme Court of the State of Hawai’i (RSCH), and further note Respondent Carroll avers and admits to misconduct that we conclude represents violations of Rules 1.2(a), 1.5, 1.6, 1.7(a), 1.7(b), 1.14(b), 1.14(c), 1.15(a)(1), 1.15(c), 1.15(d), 1.15(e), 3.4(e), and 8.4(c) of the Hawai’i Rules of Professional Conduct (1994), and Rules 8.1(a), 8.1(b), and 8.4(c) of the Hawai’i of Professional Conduct (2014). We conclude this misconduct justifies granting the petition. Therefore,
IT IS HEREBY ORDERED that the petition to resign in lieu of discipline is granted, but that Respondent Carroll’s request to resign effective October 31, 2017 is denied. The resignation shall become effective 30 days after the date of this order, pursuant to RSCH Rules 2.14(d) and 2.16(c).
IT IS FURTHER ORDERED that the Clerk of this court shall remove John S. Carroll’s name from the role of attorneys licensed to practice law in this jurisdiction and, within thirty days after entry of this order, Respondent Carroll shall submit to the Clerk the original certificate evidencing his license to practice law in this jurisdiction or an affidavit establishing good cause for his failure to do so.
IT IS FURTHER ORDERED that Respondent Carroll shall comply with the requirements of RSCH Rule 2.16 governing disbarred attorneys, the Disciplinary Board of the Supreme Court of the State of Hawai’i shall provide notice of the disbarment as required by RSCH Rule 2.16(e), and the Clerk shall provide notice to all state judges, pursuant to RSCH Rule 2.16(f).
IT IS FINALLY ORDERED that Respondent Carroll shall bear the costs of these proceedings upon the timely submission by ODC of a verified bill of costs, as authorized by RSCH Rule 2.3(c).

Therefore,
IT IS HEREBY ORDERED that, pursuant to RSCH Rule 2.12A, Respondent Agmata is suspended from the practice of law. This order is effective immediately and until further order of this court.
IT IS FURTHER ORDERED that this order imposing suspension upon Respondent Agmata shall constitute a suspension for purposes of RSCH Rule 2.16. Upon consideration of the Report and Recommendation of the Disciplinary Board of the Supreme Court of the State of Hawai’i, the stipulated facts, and the evidence in the record, we note Respondent Jamae K.K. Kawauchi has stipulated that she withdrew from her client trust account client funds for her own use and benefit that she had not earned, failed to inform the client of the withdrawals, allowed the balance of the client trust account to fall below the level of funds to which clients had a claim, failed, over a five-month period, to promptly refund monies that were the property of the client, failed to use pre-printed deposit slips labeled with her client trust account information, and misrepresented on her annual IOLTA registration form filed with the Hawai’i State Bar Association that she maintained client funds in accordance with Rule 1.15 of the Hawai’i Rules of Professional Conduct (HRPC), when she did not. Respondent Kawauchi’s conduct constitutes violations of HRPC Rules 1.5(b), 1.15(a), 1.15(c), 1.15(d), 1.16(d) and 8.4(c) (2014). Respondent Kawauchi further stipulates that, in aggravation, she has substantial experience in the practice of law and committed further misconduct during the disciplinary process, and her conduct had a dishonest or selfish motive and represents multiple violations of the HRPC, while ODC stipulated that Respondent Kawauchi, prior to the present matter, had a clean disciplinary record, made full and free disclosures, and displayed a cooperative attitude toward the proceedings. We further note Respondent Kawauchi, after five months, fully refunded the requested amount. Upon a review of the record, precedent, and the ABA Standards for Imposing Lawyer Sanctions, it appears a period of suspension is warranted. See ODC v. Avinante, SCAD-14-775, June 12, 2014; ODC v. Eliason, SCAD-12-822 (January 23, 2013); ODC v. DuBos, No. 18113 (July 26, 1994); ABA
Standard
7.2.
IT IS HEREBY ORDERED that Respondent Jamae K.K. Kawauchi is suspended from the practice of law for 150 days, effective 30 days from the entry date of this order.
IT IS FURTHER ORDERED that Respondent Kawauchi shall, within 365 days after the entry date of this order, submit to this court proof of her completion of the Multi-State Professional Responsibility Exam (MPRE) with a score sufficient
to satisfy the requirements of Rule 1.3(g)(6) of the Rules of the Supreme Court of the State of Hawai’i (RSCH). Failure to timely submit such proof may, upon a review of the record, result in a further period of suspension.
IT IS FURTHER ORDERED that, pursuant to RSCH Rule 2.16(d), within 10 days of the effective date of her suspension, Respondent Kawauchi shall submit to this court proof of compliance with the conditions of her suspension.
IT IS FURTHER ORDERED that Respondent Kawauchi shall bear the costs of these disciplinary proceedings, upon the timely submission to this court of a verified bill of costs by ODC, pursuant to RSCH Rule 2.3(c).
IT IS FINALLY ORDERED that Respondent Kawauchi,
pursuant to RSCH Rule 2.17(a), may not resume the practice of law until reinstated by entry of an order by this court.

Upon consideration of the petition submitted on March 7, 2017 by the Office of Disciplinary Counsel (ODC), requesting the immediate suspension of Respondent Ronald V. Grant from the practice of law pursuant to RSCH Rule 2.12A of the Rules
of the Supreme Court of the State of Hawai’i (RSCH), the declaration and exhibits attached thereto, and the record, we find Respondent Grant has, for more than one year, failed to meaningful or substantively respond to lawful requests from ODC regarding its investigations into alleged misconduct by Respondent Grant, despite the provision by ODC of numerous extensions of time for Respondent Grant to provide a response. We find that Respondent Grant has wholly failed to respond since May 4, 2016 to ODC’s attempts to communicate with him by telephone, electronic mail, or post at both his contact information registered with the Hawai’i State Bar Association and other contact information identified by ODC. Finally, we find Respondent Grant has failed to timely respond to this court’s March 15, 2017 order to show cause as to why he should not be immediately suspended for the above conduct. Therefore,
IT IS HEREBY ORDERED that, pursuant to RSCH Rule 2.12A, Respondent Ronald V. Grant is suspended from the practice of law. This order is effective immediately and until further order of this court.
IT IS FURTHER ORDERED that this order imposing suspension upon Respondent Grant shall constitute a suspension of Respondent Grant for purposes of RSCH Rule 2.16. The Disciplinary Board of the Supreme Court of the State of Hawai’i and Respondent Grant shall therefore comply with the relevant requirements of that Rule.
IT IS FINALLY ORDERED that the Clerk shall forthwith distribute a copy of this order to all judges. Distribution may be by electronic mail.

Upon consideration of the Office of Disciplinary Counsel’s December 1, 2016 petition for issuance of a reciprocal discipline notice to Respondent Robert Sibilia, pursuant to Rule 2.15(b) of the Rules of the Supreme Court of the State of Hawai’i (RSCH), the memorandum, affidavit, and exhibits appended thereto, the December 20, 2016 Notice and Order issued by this court, and the record, it appears that, on June 23, 2016, the Supreme Court of California suspended Respondent Sibilia for one year, with all but the initial 90 days stayed, required him within one year to successfully complete the Multistate Professional Responsibility Examination, and to bear the costs of the proceedings, for misappropriating $12,933.69 from three clients in two matters due to "gross neglect." Such conduct, if committed in this jurisdiction, would violate Rule 1.15(c) of the Hawai’i Rules of Professional Conduct (1994) and, weighed in light of the aggravating and mitigating factors cited by the court, would justify suspension (see, e.g., ODC v. Avinante, SCAD-14-775 (June 12, 2014); ODC v. Green, No. 21569 (July 30, 1998); ODC v. Ikehara, No. 20652 (October 14, 1997)). It further appears that this court’s December 20, 2016 Notice and Order was served on Respondent Sibilia by post on January 4, 2017 to the address registered with the Hawai’i State Bar Association so, by the terms of the December 20, 2016 order, RSCH Rule 2.15(b), and Rules 26(a) and 26(c) of the Hawai’i Rules of Appellate Procedure, Respondent Sibilia had until February 6, 2017 to respond to the Notice with any reasons as to why reciprocal discipline should not be imposed upon him. Respondent Sibilia has not filed a response, and a review of the record and precedent demonstrates, pursuant to RSCH Rules 2.15(c) and (d), that reciprocal discipline is authorized and justified. Therefore,
IT IS HEREBY ORDERED that Respondent Robert Sibilia is suspended for 90 days from the practice of law in this jurisdiction, pursuant to RSCH Rules 2.3(a)(2) and 2.15(c), effective thirty days after the entry of this order.
IT IS FURTHER ORDERED that Respondent Sibilia shall, in accordance with RSCH Rule 2.16(d), file with this court, within
10 days after the effective date of his suspension, an affidavit showing compliance with RSCH Rule 2.16(d).
IT IS FURTHER ORDERED that Respondent Sibilia shall bear the costs of these reciprocal proceedings, pursuant to RSCH Rule 2.3(c), upon the timely submission of a verified bill of costs by the Office of Disciplinary Counsel.
IT IS FINALLY ORDERED that Respondent Sibilia shall not resume the practice of law in this jurisdiction until reinstated by order of this court, as set forth in RSCH Rules 2.17(a) and 2.17(b)(2). Any application for reinstatement shall include proof of reinstatement to, and good standing with, the California State Bar.

Upon consideration of the Report and Recommendation of the Disciplinary Board of the Supreme Court of the State of Hawai’i, the stipulated facts, and the evidence in the record, we conclude by clear and convincing evidence that Respondent Kendal A. Luke violated Rules 3.5(c) and 4.4(a) of the Hawai’i Rules of Professional Conduct (2014) by engaging in conduct toward an unrepresented opposing party in the hallway of Family Court that was highly offensive and included the repetition in a loud voice of a vulgar, gender-based slur. While we concur with the Disciplinary Board’s conclusions regarding Respondent Luke’s conduct, and concur that his conduct warrants a period of suspension, as it was committed knowingly and injured the legal profession and the system of justice of which he is a representative, we conclude a more lengthy period of suspension is warranted. Therefore,
IT IS HEREBY ORDERED that Respondent Luke is suspended from the practice of law in this jurisdiction for 90 days, effective 30 days after the entry date of this order.
IT IS FURTHER ORDERED that Respondent Luke shall submit an affidavit demonstrating compliance with RSCH Rule 2.16(d) within 10 days after the effective date of his suspension.
IT IS FURTHER ORDERED that Respondent Luke shall submit proof to this court of his successful completion of the Multi-State Professional Responsibility Examination, undertaken at his own expense, within one year of the entry date of this order. Respondent Luke is hereby notified that failure to provide such proof within the allotted time may result in a further period of suspension.
IT IS FURTHER ORDERED that Respondent Luke shall bear the costs of the disciplinary proceedings, upon timely submission by the Office of Disciplinary Counsel and approval by this court of a verified bill of costs, pursuant to Rule 2.3(c) of the Rules of the Supreme Court of the State of Hawai’i.

Upon consideration of the petition submitted by the Disciplinary Board of the Supreme Court of the State of Hawai’i for an order granting the request of attorney Melodie R. Williams Aduja to resign from the practice of law in lieu of discipline and the affidavit attached in support thereof, we note the petition meets the requirements of Rule 2.14(a) of the Rules of the Supreme Court of the State of Hawai’i (RSCH) and that Respondent Aduja avers and admits misconduct sufficient to justify granting the petition. Therefore,
IT IS HEREBY ORDERED that the petition to resign in lieu of discipline is granted.
IT IS FURTHER ORDERED that Respondent Aduja’s resignation shall become effective 30 days after the date of this order, as provided by RSCH Rules 2.14(d) and 2.16(c).
IT IS FURTHER ORDERED that the Clerk of this court shall remove Respondent Aduja’s name from the role of attorneys licensed to practice law in this jurisdiction and, within thirty days after entry of this order, Respondent Aduja shall submit to the Clerk the original certificate evidencing her license to practice law in this jurisdiction or an affidavit establishing good cause for her failure to do so.
IT IS FURTHER ORDERED that Respondent Aduja shall comply with the requirements of RSCH Rule 2.16 governing disbarred attorneys and the Disciplinary Board shall provide notice of the disbarment as required by RSCH Rules 2.16(e) and 2.16(f).
IT IS FINALLY ORDERED that Respondent Aduja shall bear the costs of these proceedings upon the timely submission by ODC of a verified bill of costs, as authorized by RSCH Rule 2.3(c).

ORDER OF DISBARMENT

Upon a thorough de novo review of the March 23, 2016 report filed by the Disciplinary Board of the Supreme Court of the State of Hawai’i, the record, and the briefs and exhibits appended thereto, submitted by Respondent Locricchio and the Office of Disciplinary Counsel (ODC), we find and conclude the following based upon clear and convincing evidence contained in the record.
The Hearing Officer in this matter made more than reasonable accommodations for Respondent Locricchio regarding the disciplinary hearing, and Respondent Locricchio had adequate notice of the date and time of the hearing. The Hearing Officer was justified in convening the hearing, declaring Locricchio in default, and entering evidence into the record.
In ODC Case No. 13-066-9136, we further conclude that when, on June 4, 2010 and June 24, 2010, Respondent Locricchio wrote to his client and stated in pertinent part he was transferring the funds in question to a Special Client Trust Account on the advice of ODC, and when he wrote to opposing counsel on August 26, 2010 and made similar statements, he misrepresented the truth, in violation of Rules 4.1(a) and 8.4(c) of the Hawai’i Rules of Professional Conduct (HRPC) (1994). We conclude Respondent Locricchio repeatedly violated the United States Bankruptcy Court’s July 13, 2010 and November 2, 2010 orders, and misappropriated funds, when he made payments from the Special Client Trust Account by executing checks in 2010 (dated July 24, August 25, November 3, November 11, December 2, December 12, December 15, and December 22), in 2011 (dated January 24, January 27, February 28, March 1, March 15, March 29, May 11, May 12, June 22, June 29, July 5, July 6, August 22, August 25, September 4, September 8, September 12, September 16, October 11, October 24, October 26, October 30, November 2, November 9, November 10, November 21, and December 21), and in 2012 (dated January 3, February 7, March 15, May 23, May 27, July 12, August 13 and August 15), each check constituting a violation of HRPC Rules 1.15(c), 1.15(f)(4), 3.4(e) and 8.4(c). When, on October 18, 2010, Respondent Locricchio did not appear at the hearing on the opposing party’s motion for an order to show cause, Respondent Locricchio had not sought, or obtained, leave to withdraw as counsel, as required under by the rules of the Bankruptcy Court and, by failing to appear or to properly withdraw, violated HRPC Rules 1.16(d) and 3.4(e). When, on December 2, 2010, Respondent Locricchio failed to transfer the funds in the Special Client Trust Account to the United States District Court Registry, he violated 28 U.S.C. § 1335, thereby violating HRPC Rule 3.4(e). Respondent Locricchio, by failing to timely assume the leases or to obtain an extension for doing so, violated HRPC Rules 1.1 and 1.3. We further conclude, by clear and convincing evidence, that Respondent Locricchio’s cash withdrawals from the Special Client Trust Account on June 29, July 5, and July 6, 2011, and his issuance of Special Client Trust Account checks made payable to his wife, on July 24, 2010, May 12, 2011, September 8, 2011, September 16, 2011, December 2, 2011, and May 23, 2012, each represent a separate violation of HRPC Rule 1.15(e). When Respondent Locricchio stated, on December 2, 2010 in his interpleader complaint filed with the United States District Court for the District of Hawai’i was transferring the Slemons Hawai’i funds from the DIP Client trust account to the Special Client Trust Account on the advice of ODC, he made a material misrepresentation of fact to the court in violation of HRPC Rules 3.3(a)(1) and 8.4(c). When, in Respondent Locricchio’s September 12, 2012 motion in the interpleader action, he stated he had contacted ODC for advice with regards to the funds, he again made material misrepresentations of fact, again violating HRPC Rules 3.3(a)(1) and 8.4(c). By making his wife, who was not an attorney, a signatory to the Special Client Trust Account (evidenced by her execution of the November 22, 2009 check for $80,300.00 and the October 24, 2011 check for $455.00), Respondent Locricchio violated HRPC Rule 1.15(e). By depositing third-party funds into the Special Client Trust Account, on July 6, 2011, Respondent Locricchio violated HRPC Rule 1.15(c).
In ODC Case No. 14-040-9183, Respondent Locricchio’s June 22, 2010 verified complaint, and the ten subsequent motions for temporary restraining orders, all found by the United States District Court to be frivolous filings, each represent a separate violation of HRPC Rule 3.1. Respondent Locricchio’s October 29, 2010 amended complaint violated the June 25, 2010 order of the United States District Court for the District of Hawai’i and Rule 8(a) of the Federal Rules of Civil Procedure, thereby violating HRPC Rule 3.4(e).
In aggravation, we find Respondent Locricchio committed multiple offenses, engaged in bad faith obstruction of the disciplinary proceedings by repeatedly seeking to delay the proceedings, filing unauthorized and unwarranted motions, and failing to appear at the August 5, 2015 disciplinary hearing, refuses to acknowledge the wrongful nature of his conduct, has substantial experience in the practice of law, is indifferent to making restitution, engaged in a pattern of misconduct, and exhibited a dishonest or selfish motive in his disbursement of more than $80,000.00 in disputed funds, including more than $64,000.00 to himself and his wife.
In light of the record and the above, disbarment is warranted. We further concur with the Disciplinary Board that, in light of the evidence in the record, it is advisable Respondent Locricchio be required to successfully complete the Hawai’i bar exam as a precondition of any subsequent application for reinstatement to practice. Therefore,
IT IS HEREBY ORDERED that Respondent Anthony P. Locricchio is disbarred from the practice of law in this jurisdiction, effective 30 days after the date of entry of this order, pursuant to Rule 2.16(c) of the Rules of the Supreme Court of the State of Hawai’i (RSCH).
IT IS FURTHER ORDERED that Respondent Locricchio shall, in accordance with RSCH Rule 2.16(d), file with this court, within 10 days after the effective date of his disbarment, an affidavit showing compliance with RSCH Rule 2.16(d) and this order.
IT IS FURTHER ORDERED that, as a condition of any future reinstatement of his license to practice law in this jurisdiction, in addition to any other requirement imposed by RSCH Rule 2.17, Respondent Locricchio shall take and pass the Hawai’i bar examination, and shall submit proof of the foregoing appended to any petition for reinstatement.
IT IS FURTHER ORDERED that Respondent Locricchio shall pay all costs of these proceedings as approved upon the timely submission of a bill of costs and an opportunity to respond thereto, as prescribed by RSCH Rule 2.3(c).
IT IS FINALLY ORDERED that Respondent Locricchio’s renewed motion for oral argument is denied.

Upon de novo review of the Report and Recommendation of the Disciplinary Board of the Supreme Court of the State of Hawai’i, the stipulated facts, and the evidence in the record, we conclude by clear and convincing evidence that Respondent William T. Martinez engaged in misconduct warranting discipline.
Respondent Martinez, by failing to timely file a request for an extension for his client’s non-immigrant visa prior to the September 9, 2012 expiration date, violated Rule 1.3 of the Hawai’i Rules of Professional Conduct (HRPC) (1994) and, by filing an erroneous petition on September 17, 2012, violated HRPC Rules 1.1, 1.2(a), and 1.3.
By failing to correctly inform his client that the subsequent September 26, 2012 Notice from the United States Citizenship and Immigration Services required the client to exit the U.S. and to re-apply at the U.S. Consulate in Venezuela in order to avoid accruing unlawful presence in the U.S., Respondent Martinez violated HRPC Rules 1.1, 1.3, 1.4(a) and 1.4(b), and, by instead informing his client the client’s visa had been successfully extended, negligently misrepresented the facts, in violation of HRPC Rule 8.4(c).
We conclude Respondent Martinez’s conduct harmed the legal system and his client, including the possibility of a bar on re-entry into the U.S., and who suffered actual monetary injury and other harm, by accruing unlawful presence in the U.S.
We find, in aggravation, Respondent Martinez has a single prior discipline - a private informal admonition in 2004 - and substantial experience in the practice of law. We find his client was vulnerable, as an immigrant for whom English was a second language, who had relied upon Respondent Martinez’s legal services to lawfully remain in the United States so the client could work and support his family.
In mitigation, we find Respondent Martinez made a full and free disclosure to the disciplinary authorities and was cooperative during the proceedings. We find he experienced during the relevant period personal problems related to his family’s health. We note his good character and reputation in the community, his pro bono work for the artistic community, and the remorse he demonstrated by taking steps to remedy his errors prior to the filing of a complaint against him. We note the prior discipline is remote in time.
Therefore, it appearing that a period of suspension is appropriate,
IT IS HEREBY ORDERED that Respondent Martinez is suspended from the practice of law in this jurisdiction for 45 days, effective 30 days after the date of entry of this order, as provided by Rules 2.3(a)(2) and 2.16(c) of the Rules of the Supreme Court of the State of Hawai’i (RSCH).
IT IS FURTHER ORDERED that Respondent Martinez shall pay restitution to his client named in this matter the sum of $2,471.00 and shall submit proof of payment to this court, within one year of the entry date of this order.
IT IS FURTHER ORDERED that, in addition to any other requirements for reinstatement imposed by the Rules of the Supreme Court of the State of Hawai’i, Respondent Martinez shall pay all costs of these proceedings as approved upon the timely submission of a bill of costs by the Office of Disciplinary Counsel, as prescribed by RSCH Rule 2.3(c).
IT IS FINALLY ORDERED that Respondent Martinez shall, within ten days after the effective date of his suspension, file with this court an affidavit he has fully complied with the duties of a suspended attorney set forth in RSCH Rule 2.16(d).

Upon consideration of the Office of Disciplinary Counsel’s petition for issuance of a reciprocal discipline notice to Respondent Stephen Carl Woodruff, the memorandum, affidavit, and exhibits appended thereto, the materials subsequently submitted by Respondent Woodruff, and the record as a whole, we note the Supreme Court of the Commonwealth of the Northern Mariana Islands (CNMI) affirmed Respondent Woodruff’s disbarment on December 9, 2015 and the matter has since become ripe for disposition by this court, pursuant to Rule 2.15 of the Rules of the Supreme Court of the State of Hawai’i (RSCH).
Upon a thorough review of the record in this matter, and a careful analysis of Respondent Woodruff’s arguments, we conclude that Respondent Woodruff did not establish any of the four grounds available under RSCH Rule 2.15(c)(1) - (4) to avoid reciprocal discipline in this jurisdiction. We further conclude that, had Respondent Woodruff engaged in this jurisdiction in the misconduct at issue in this matter, in nine separate client representations, said conduct would represent multiple violations of Rules 1.1, 1.3, 1.4(a), 1.4(b), 1.5, 3.1, 3.2, 3.3(a)(2), and 8.1(b) of the Rules of Professional Conduct (1994), conduct which would warrant disbarment in this jurisdiction, see ODC v. Russell, SCAD-11-358 (May 23, 2011); ODC v. Gravelle, No. 27808 (November 8, 2007); ODC v. Burns, No. 20882 (December 17, 1999). Therefore,
IT IS HEREBY ORDERED, pursuant to RSCH Rule 2.15(c), that Respondent Woodruff is disbarred from the practice of law in the State of Hawai’i, effective thirty days after the date of entry of this order, pursuant to RSCH Rule 2.16(c).

The February 18, 2015 report submitted to this court by the Disciplinary Board of the Hawai’i Supreme Court, the exhibits appended thereto, the briefs submitted to this court, and the record in this matter, establish that Respondent Michael G.M. Ostendorp represented, from October 1, 2009 to October 7, 2009, four clients, Mr. K, an individual whose dogs had been seized by the Hawai’i Island Humane Society (HIHS) pursuant to a search warrant, K’s sister, R, a family trust, and a family partnership, and that the representation was both in relation to the seized dogs and to safeguard family assets, including assets located at the property from which the dogs were seized. The record also supports the conclusion that, on the morning of October 7, 2009, Respondent Ostendorp represented that he had a valid power of attorney and directed his legal assistant to make similar representations on four separate occasions, when, in fact, he did not possess a valid power of attorney until the next day, thereby committing one violation of Rule 8.4(c) of the Hawai’i Rules of Professional Conduct (HRPC) (1994) and four violations of HRPC Rule 5.3(c).
The record supports the conclusion that, by informing the Office of Disciplinary Counsel (ODC) by letter on October 13, 2011 that K was never his client, when the record contains clear and convincing evidence Respondent Ostendorp considered K his client from October 1 to October 7, 2009, and made such representations to third persons, Respondent Ostendorp again violated HRPC Rule 8.4(c).
Upon review of the record, however, we conclude ODC did not establish, by clear and convincing evidence, that Respondent Ostendorp could not reasonably conclude the interests of K, R, the family trust and the family partnership were sufficiently in convergence to simultaneously represent the parties as their attorney during the relevant period, insofar as both K and R were both aware of K’s spendthrift habits and sought Respondent Ostendorp’s counsel as to how best to protect the assets in question. We therefore decline to adopt the Hearing Officer’s violations of HRPC Rules 1.7(a) or 1.7(b).
Furthermore, we decline to adopt the violations found by the Hearing Officer of HRPC Rules 1.9(a), 1.9(b), 1.9(c), 1.15(g), 4.1(a), 5.3(a), and 5.3(b), because those violations could have been alleged in the original petition or the pre-hearing statement but were not. Cf. ODC v. Fernandez, SCAD-12- 376, (February 14, 2013) (wherein this court found a violation of HRPC Rule 8.1(a) that was not alleged in the original petition, but was based upon clear evidence in the record and upon admissions made by the respondent attorney during the disciplinary hearings themselves). We conclude ODC failed, in its pre-hearing statement, to allege a violation of HRPC Rule 1.15(a)(2) with sufficient clarity to allow Respondent Ostendorp to mount an appropriate defense. See In re Ruffalo, 390 U.S. 544, 545-47 (1968).
We find, in aggravation, that Respondent Ostendorp had substantial experience in the practice of law, three prior disciplines, 1 and multiple violations in the present matter. We decline, however, to adopt the Hearing Officer’s finding that K and R were vulnerable victims, concluding that neither individual was particularly vulnerable or fragile. See Florida Bar v. Ticktin, 14 So.3d 928, 938 (Fla. 2009); In re Disciplinary Proceedings Against Day, 173 P.3d 915, 920 (Wash. 2007); In re Disciplinary Proceeding Against Christopher, 105 Wash.2d 669, 682-83 (Wash. 2005).

We conclude that the record does not support the Hearing Officer’s finding of a mitigating factor of remorse. We also do not concur that the disciplinary proceedings were delayed to such a degree as to justify mitigating the contemplated discipline. We further note much of the delay since submission of the Board’s report to this court lies with Respondent Ostendorp.
In light of the above, we conclude a substantial period of suspension is warranted. Therefore,
IT IS HEREBY ORDERED Respondent Ostendorp is suspended from the practice of law in this jurisdiction for a period of six months, effective 30 days after the entry date of this order, as provided by Rules 2.3(a)(2) and 2.16(c) of the Rules of the Supreme Court of the State of Hawai’i (RSCH). Respondent Ostendorp is reminded he may not resume the practice of law until reinstated by order of this court at the conclusion of this period of suspension, pursuant to RSCH Rule 2.17(b)(2).
IT IS FURTHER ORDERED, as recommended by the Disciplinary Board, that Respondent Ostendorp shall successfully complete, within 365 days after the date of entry of this order and at his own cost and expense, an audit of his practice by the Practicing Attorneys’ Liability Management Society (PALMS) or an equivalent program regarding his practice, particularly as to the proper receipt, maintenance, and disbursement of client funds under the Hawai’i Rules Governing Trust Accounting. Respondent Ostendorp shall, within that 365-day period, submit to this court proof of completion of the audit, and of his compliance with the audit’s resulting recommendations, or good cause for an extension. Though submission of the audit report is not a prerequisite to Respondent Ostendorp’s reinstatement, Respondent Ostendorp is hereby notified that failure to complete the audit and submit proof within the deadline set by this court may result in a further period of suspension, upon a review of the entire record.
IT IS FURTHER ORDERED that, in addition to any other requirements for reinstatement imposed by the Rules of the Supreme Court of the State of Hawai’i, Respondent Ostendorp shall pay all costs of these proceedings as approved upon the timely submission of a bill of costs by ODC, as prescribed by RSCH Rule 2.3(c).
IT IS FINALLY ORDERED that Respondent Ostendorp shall, within ten days after the effective date of his suspension, file with this court an affidavit he has fully complied with the duties of a suspended attorney, as set forth in RSCH Rule 2.16(d).

Upon consideration of the Office of Disciplinary Counsel’s February 26, 2016 petition for issuance of a reciprocal discipline notice to Respondent Thomas Alfred Landry, pursuant to Rule 2.15(b) of the Rules of the Supreme Court of the State of Hawai’i (RSCH), the memorandum, declaration, and exhibits appended thereto, the March 15, 2016 notice of reciprocal discipline issued bythis court, and Respondent Landry’s March 29, 2016 submission, we note that, on October 27, 2015, the Massachusetts Supreme Judicial Court for Suffolk County issued an order suspending Landry from the practice of law in that jurisdiction for nine months, for charging and collecting an excessive fee, failing to explain the contingent fee agreement to the clients with sufficient clarity to enable them to make an informed decision, and for knowingly giving false answers to the clients’ questions regarding the fee agreement, in violation of Rules 1.5(a), 1.4(b), and 8.4(c) of the Massachusetts Rules of Professional Conduct. Respondent Landry’s conduct, if committed in this jurisdiction, would constitute violations of Rules 1.4(b), 1.5(a), and 8.4(c) of the Hawai’i Rules of Professional Conduct. A review of the record establishes that none of the grounds set forth in RSCH Rule 2.15(c) for avoidance of reciprocal discipline in this jurisdiction exist in the present matter, and Respondent Landry’s conduct, if committed in this jurisdiction, would justify a nine-month suspension. Therefore,
IT IS HEREBY ORDERED that Respondent Thomas Alfred Landry is suspended for nine months from the practice of law in this jurisdiction, pursuant to RSCH Rules 2.3(a)(2) and 2.15(c), effective thirty days after the entry of this order.
IT IS FURTHER ORDERED that Respondent Landry shall, in accordance with RSCH Rule 2.16(d), file with this court, within 10 days after the effective date of his suspension, an affidavit showing compliance with RSCH Rule 2.16(d).
IT IS FURTHER ORDERED that Respondent Landry shall bear any costs associated with these reciprocal proceedings, pursuant to RSCH Rule 2.3(c), upon approval of a timely-submitted verified bill of costs by the Office of Disciplinary Counsel.
IT IS FINALLY ORDERED that Respondent Landry’s reinstatement to practice in this jurisdiction is contingent upon submission of proof to this court of his successful reinstatement to practice in Massachusetts.

Upon consideration of the Report and Recommendation of the Disciplinary Board of the Supreme Court of the State of Hawai’i, submitted to this court on December 10, 2015, for the imposition of, inter alia, a six-month suspension upon Respondent Robin Horner, and upon a review of the record, this court adopts the Findings of Fact as articulated by the Hearing Officer and amended by the Board in its report to this court. Furthermore, upon a review of the record, including the exhibits submitted by the Disciplinary Board, we find and conclude the following by
clear and convincing evidence:
In Office of Disciplinary Counsel (ODC) Case No. 13- 054-9124, Respondent Horner charged a $2,400.00 non-refundable fee and deposited at least $1,000.00 of those received funds directly into his business account, in violation of Rule 1.15(d) of the Hawai’i Rules of Professional Conduct (HRPC) (1994).1 Respondent Horner also failed to maintain a subsidiary ledger for the those funds, in violation of HRPC Rules 1.15(f)(3) and 1.15(g), and did not timely respond to ODC’s requests for information regarding the representation, or provide ODC with all of the financial records requested, in violation of HRPC Rules 8.1(b) and 8.4(d).
In ODC Case No. 13-055-9125, Respondent Horner charged the client a non-refundable fee and deposited the resulting $2,400.00 payment directly into his business account, in violation of HRPC Rule 1.15(d), did not maintain a subsidiary ledger for the client’s funds, in violation of HRPC Rule 1.15(f)(3) and 1.15(g), and did not timely respond to ODC’s requests for information regarding the representation, or provide ODC with all of the financial records requested, in violation of HRPC Rules 8.1(b) and 8.4(d).
In ODC Case No. 13-058-9128, Respondent Horner charged the client a non-refundable fee and deposited the client’s payment of $1,000.00 toward that fee directly into his business account, in violation of HRPC Rule 1.15(d), failed to maintain the required financial records regarding those funds, in violation of HRPC Rules 1.15(f)(3) and 1.15(g), and failed to timely respond to inquiries from ODC regarding the representation, or to provide the financial information contained therein, in violation of HRPC Rules 8.1(b) and 8.4(d).

In ODC Case Nos. 13-059-9129 and 13-060-9130, in the appeal to the Intermediate Court of Appeals (ICA), Respondent Horner failed to obey the requirements of Rule 32.1 of the Hawai’i Rules of Appellate Procedure (HRAP) by providing paper copies of the opening brief within one business day of filing it, thereby violating HRPC Rules 3.2 and 3.4(e). Respondent Horner also failed to respond to the ICA’s July 12, 2013 order to show cause as to why he should not be sanctioned for that failure and also failed to timely pay a $100.00 sanction imposed on September 12, 2013, representing two additional violations of HRPC Rule 3.4(e).
In ODC Case No. 13-061-9131, Respondent Horner failed to provide the court with paper copies of the opening brief within one day of filing it, as required by HRAP Rule 32.1, and failed again to provide the copies when ordered to do so by the ICA on May 23, 2013, representing two separate violations of both HRPC Rules 3.2 and 3.4(e);
In ODC Case No. 14-038-9181, Respondent Horner failed to provide the court with paper copies of the opening brief within one day of filing it, as required by HRAP Rule 32.1, thereby violating HRPC Rules 3.2 and 3.4(e), and then failed to respond to the ICA’s May 12, 2014 order to show cause, failed to timely pay the $100.00 sanction imposed on June 9, 2014, and failed to timely pay the additional $150.00 sanction imposed on June 27, 2014, representing three additional violations of HRPC Rule 3.4(e).
In aggravation, we find Respondent Horner has substantial experience in the practice of law, has in his record one prior discipline, a public reprimand delivered in 2013, multiple violations in the present matter, and a pattern of misconduct, both in charging purportedly non-refundable fees and in repeatedly failing to conform to court rules and to obey court orders. We find no mitigating factors present. Therefore, in light of the above misconduct, and a review of past disciplinary precedent (see, e.g., ODC v. Wooten, SCAD-14-1333 (December 11, 2015); ODC v. Baker, No. 26392 (July 24, 2006); ODC v. Wessel, No 23417 (May 23, 2000); ODC v. Dryer, No. 22244, (February 16, 2000)), we conclude that a period of suspension is warranted. Therefore,
IT IS HEREBY ORDERED that Respondent Robin Horner is suspended from the practice of law in this jurisdiction for 180 days, effective 30 days from the date of entry of this order, as provided by Rules 2.3(a)(2) and 2.16(c) of the Rules of the Supreme Court of the State of Hawai’i (RSCH). At the conclusion of the 180-day period of suspension, Respondent Horner may apply for reinstatement, as provided by RSCH Rule 2.17(b)(2). Respondent Horner is reminded he may not resume the practice of law until reinstated by order of this court, pursuant to RSCH Rule 2.17.
IT IS FURTHER ORDERED that Respondent Horner shall submit an affidavit demonstrating compliance with RSCH Rule 2.16(d) within 10 days after the effective date of his suspension.
IT IS FURTHER ORDERED that Respondent Horner shall successfully complete, within 365 days after the date of entry of this order and at his own cost and expense, an audit of his practice by the Practicing Attorneys Liability Management Society (PALMS) or an equivalent program, which shall evaluate, audit, and educate Respondent Horner regarding his practice, particularly as to properly submitting and monitoring court filings and as to the proper receipt, maintenance, and disbursement of client funds under the Hawai’i Professional Conduct and the Hawai’i Accounting. Respondent Horner shall, within that 365-day period, submit to this court proof of completion of the audit, and of compliance with the audit’s resulting recommendations, or good cause for an extension.
IT IS FURTHER ORDERED that Respondent Horner shall, within the same 365-day period after the entry date of this order, obtain a passing score on the M.P.R.E. satisfactory to the Hawai’i Board of Bar Examiners for new admittees, or good cause for an extension.
IT IS FURTHER ORDERED that Respondent Horner is hereby notified that failure to timely and successfully complete the audit and implementation of its recommendations or to obtain a passing score on the M.P.R.E. may result in the imposition of an additional period of suspension, based upon a review of the record and any program reports.
IT IS FURTHER ORDERED that Respondent Horner shall pay all costs of the proceedings, as approved upon a timely submission of a bill of costs, as authorized by RSCH Rule 2.3(c).

Upon consideration of the December 2, 2014 report submitted by the Disciplinary Board of the Hawai`i Supreme Court, the exhibits appended thereto, the briefs submitted to this court, the allegations made by the Office of Disciplinary Counsel in its Summons and Petition, and the record in this matter, we make the following Findings of Fact and Conclusions of Law based upon clear and convincing evidence.
In ODC Case No. 11-025-8949, Respondent Wooten charged a non-refundable retainer fee, in violation of Rule 1.15(d) of the Hawai`i Rules of Professional Conduct (HRPC) (1994).1 Respondent Wooten did not communicate in a reasonable and timely manner with his client regarding her request to amend the initial complaint filed in her lawsuit, and did not inform her he had decided to postpone further work on her case until further payment of his retainer was received, in violation of HRPC Rules 1.4(a) and 1.4(b). Respondent Wooten did not amend the complaint until after both the expiration of the October 27, 2005 deadline imposed by the Equal Employment Opportunity Commission on litigating the underlying claims, or the November, 2005 running of the two-year statute of limitations of his client’s assertion of her defamation and slander claims, and the United States District Court for the District of Hawai`i relied in part, when dismissing his client’s suit, on the fact the claims against two of the defendants were time-barred due to the late filing of the amended complaint, grounds which were affirmed by the United States Court of Appeals for the Ninth Circuit, conduct which violatedHRPC Rule 1.3. We note Respondent Wooten’s client, in her initial complaint to the Office of Disciplinary Counsel (ODC), complained of Wooten’s failure to offer to refund her fees for what she deemed sub-standard services, but that the record does not contain any evidence she requested from Wooten an accounting of the fees earned by him over the course of the representation, nor did ODC allege the fees charged were unreasonable, and further note the record does contain reasonable assertions by Wooten the fees were fully earned, and therefore decline to find a violation of HRPC Rule 1.15(f)(3). See ODC v. Manuia, SCAD-13-136 Docket 13:4.

In ODC Case No. 11-065-8990, Respondent Wooten inadvertently overpaid a client an award in a settlement of an insurance claim, thereby overdrawing his client trust account, in violation of HRPC Rule 1.15(d), though we further find the incident was due to negligence or inattention and not based upon a selfish or dishonest motive. Respondent Wooten also did not maintain a subsidiary ledger of the client’s funds, in violation of HRPC Rule 1.15(g)(2). The record, however, does not support the conclusion that Respondent Wooten violated HRPC Rule 1.15(c) by allegedly failing to promptly remove his contingency fee from the client trust account but, rather, that he promptly removed the funds but erroneously provided his client with a portion of them.
In ODC Case No. 12-041-9057, Wooten, in responding to an order to show cause from the Intermediate Court of Appeals (ICA) arising from his failure to file an opening brief in a timely manner, failed to obey a directive of the ICA, in violation of HRPC Rule 3.4(e), by filing his response to the court’s order as an unsigned "memorandum of explanation," rather than as an affidavit or a declaration, as expressly required by the order.
In aggravation, we find multiple violations in the present matter and two prior disciplines by this court, reflecting a pattern of conduct that failed to meet the professional standards of organization, efficiency, diligence, and promptness required of an attorney, despite Respondent Wooten’s substantial number of years in practice.
In mitigation, we note Respondent Wooten’s misconduct does not arise from a selfish or dishonest motive, and note his role as an advocate for the underserved members of the community, and his cooperative attitude during the disciplinary investigation and proceedings.
Finally, we conclude there was nothing improper about the timing of this disciplinary proceeding in relation to the earlier disciplinary proceedings concluded against Respondent Wooten on February 15, 2013 (hereinafter, "the 2010 proceedings"). The complaint for the earliest of the three instant matters, in ODC Case No. 11-028-8949, was not received by ODC until December 9, 2010, more than three months after the 2010 proceedings had commenced with the August 26, 2010 issuance of the summons and petition in that matter. ODC was notified of the second of the three instant matters, ODC Case No. 11-065-8990, on May 3, 2011, while the 2010 proceedings were engaged in hearings. The most recent of the three instant matters, ODC Case No. 12-041-9057, was received from the ICA on August 20, 2012, after the 2010 proceedings had concluded hearings and the matter had been submitted to this court for disposition. ODC cannot be faulted for pursuing the earlier disciplinary proceedings even as new complaints of misconduct against Respondent Wooten were brought to ODC’s attention.
In sum, upon review of the record and the pattern of misconduct evidenced by it, we conclude a substantial period of suspension is necessitated to protect the public. See Akinaka v. Disciplinary Bd. of the Hawai`i Supreme Court, 91 Hawai`i 51, 55, 57-58, 979 P.2d 1077, 1081, 1083-84 (1999). Therefore,
IT IS HEREBY ORDERED that Respondent André S. Wooten is suspended from the practice of law in this jurisdiction for six months, effective 30 days after the entry date of this order, as provided by Rules 2.3(a)(2) and 2.16(c) of the Rules of the Supreme Court of the State of Hawai`i (RSCH).
IT IS HEREBY FURTHER ORDERED that, in addition to any other requirements for reinstatement imposed by the Rules of the Supreme Court of the State of Hawai`i, Respondent Wooten shall pay all costs of these proceedings as approved upon timely submission of a bill of costs, as authorized by RSCH Rule 2.3(c).
IT IS FURTHER ORDERED that Respondent Wooten shall, within 10 days after the effective date of his suspension, file with this court an affidavit in full compliance with RSCH Rule 2.16(d).
IT IS FINALLY ORDERED that, in light of the pattern and nature of the misconduct underlying Respondent Wooten’s suspension, proof of completion of the audit of his practice by the Practicing Attorneys Liability Management Society (PALMS) and of adoption of its recommendations must accompany any affidavit submitted by Respondent Wooten, pursuant to RSCH Rule 2.17(b)(2), to obtain reinstatement.

Upon consideration of the petition for issuance of a reciprocal discipline notice upon Respondent Ira Dennis Hawver, filed on January 7, 2015 by the Office of Disciplinary Counsel pursuant to Rule 2.15(b) of the Rules of the Supreme Court of the State of Hawai’i (RSCH), and the memorandum and exhibits appended thereto, we note that, on November 14, 2014, the Supreme Court of the State of Kansas disbarred Respondent Hawver for misconduct committed during his representation in a capital murder case in which his client was sentenced to death, misconduct which included incompetence, charging a fee which gave rise to an improper conflict of interest, engaging in conduct that was prejudicial to the administration of justice and which adversely reflected upon his fitness to practice law, and for failing to timely respond to a formal disciplinary complaint, which constituted violations of Kansas Rules of Professional Conduct Rules 1.1, 1.5, 1.7(a)(2), 1.16(a)(1), 8.4(d), and 8.4(g) and Kansas Rules of the Supreme Court Rule 211(b) and which, if committed in this jurisdiction during the relevant time period, would constitute violations of Rules 1.1, 1.5(a), 1.7(b), and 1.16(a)(1) of the Hawai’i Rules of Professional Conduct (1994). Hawver did not submit any arguments as to why a substantially similar discipline should not be imposed upon him in this jurisdiction, and none clearly appears upon the face of the Kansas record. Therefore, in light of the above and the particularly grave consequences of incompetent representation in a capital murder case,
IT IS HEREBY ORDERED Respondent Hawver is disbarred from the practice of law in this jurisdiction, effective 30 days after the date of entry of this order.
IT IS FURTHER ORDERED that, as a condition of reinstatement, in addition to any requirements imposed pursuant to RSCH 2.3, 2.16, and 2.17, Respondent Hawver shall pay all costs of these proceedings as approved upon the timely submission by the Office of Disciplinary Counsel of a bill of costs and an opportunity to respond thereto, as prescribed by RSCH Rule 2.3(c).
IT IS FINALLY ORDERED that Respondent Hawver shall, within 10 days after the effective date of his suspension, file an affidavit with this court that he has complied with the duties and obligations of a disbarred attorney, as set forth in RSCH 2.16(d).

Upon consideration of the Office of Disciplinary Counsel’s December 22, 2014 petition for issuance of a reciprocal discipline notice to Respondent Mark L. Weber, pursuant to Rule 2.15(b) of the Rules of the Supreme Court of the State of Hawai’i (RSCH), the memorandum, affidavit, and exhibits appended thereto, the December 30, 2014 Notice of Reciprocal Discipline issued by this court, and the record, it appears that, on April 8, 2014, the Supreme Court of California disbarred Respondent Weber for stealing numerous checks from his firm’s accounts, forging the firm’s signatory attorney’s signature or otherwise altering them, and converting the $11,126.00 in proceeds to his own use and benefit, over a twelve-month period, despite being given repeated chances by his law firm to reform his conduct, thereby, in the conclusion of the California Supreme Court, "wilfully engag[ing] in acts of moral turpitude, dishonesty, and corruption." The California Supreme Court found no factors in mitigation, and found, in aggravation, that Weber demonstrated bad faith, dishonesty, indifference toward rectification or atonement for the harm inflicted on others, and contempt for the disciplinary proceedings. Such conduct, if committed in this jurisdiction, would represent violations of HRPC Rules 8.4 (c) and 8.4(g) and justify disbarment. It further appears that this court’s December 30, 2014 Notice of Reciprocal Discipline was served on Respondent Weber on February 19, 2015 and, by the terms of the December 30, 2014 order, RSCH Rule 2.15(b), and Rule 6(a) of the Hawai’i Rules of Civil Procedure, Respondent Weber had until
March 23, 2015 to respond to the Notice with any reasons as to why reciprocal discipline should not be imposed upon him. Respondent Weber has failed to respond and a review of the record and precedent demonstrates, pursuant to RSCH Rules 2.15(c) and (d), that reciprocal discipline is authorized and justified. Therefore,
IT IS HEREBY ORDERED that Respondent Mark L. Weber is disbarred from the practice of law in this jurisdiction, pursuant to RSCH Rules 2.3(a) (1) and 2.15(c), effective thirty days after the entry of this order.
IT IS FURTHER ORDERED that Respondent Weber shall, in accordance with RSCH Rule 2.16(d), file with this court within 10 days after the effective date of his disbarment, an affidavit showing compliance with RSCH Rule 2.16(d).

The Indiana Supreme Court also concluded Lehman’s commingling of client and attorney funds, and failure to maintain proper financial records, also violated Rules 23(29)(a)(2), 23(29)(a)(3) and 23(29)(a)(4) of the Indiana Admission and Discipline Rules. Lehman’s conduct set forth in the record, if committed in this jurisdiction, would represent violations of Hawai’i Rules of Professional Conduct Rules 1.1, 1.2(a), 1.3, 1.4(b), 1.6(a), 1.9(c)(2), 1.15(a), 3.2, and 3.4(e). Respondent Lehman, in his response, argues denial of due process and infirmity of proof sufficient to establish an exception to reciprocal discipline under RSCH Rules 2.15(c)(1) and (2), and for a substantially reduced discipline, pursuant to RSCH Rule 2.15(c)(4). A review of the record, however, demonstrates Respondent Lehman was provided notice of the proceedings against him, participated in the process, and was afforded an opportunity to be heard both at the hearings and thereafter by written submission. The record also demonstrates Respondent Lehman exceeded by more than two months the deadline imposed through published court rule for him to request review by the Indiana Supreme Court, and only filed said request after the court entered its final judgment in the matter. In short, a review of the record does not support Respondent Lehman’s contentions. Respondent Lehman’s conduct, if committed in this jurisdiction, would not warrant a substantially different discipline than that imposed by the Supreme Court of Indiana. Therefore,
IT IS HEREBY ORDERED that Respondent Joseph C. Lehman is suspended for two years from the practice of law in this jurisdiction, pursuant to RSCH Rules 2.3(a)(2) and 2.15(c), effective thirty days after the entry of this amended order. We further note Respondent Brawley admits to failing to maintain a business account for her practice, withdrawing client funds for her own use and benefit before earning them, failing to keep client funds in trust until earned, misrepresenting material facts to ODC during its investigation, and creating a false deposit slip in support of those misrepresentations, in violation of Rules 1.15 (a) (2), 1.15(c), and 1.15(d) of the Hawai’i Rules of Professional Conduct (HRPC) (1994) and HRPC Rule 8. 4 (c) (2014). IT IS HEREBY ORDERED, pursuant to RSCH Rule 2 .14, that the petition is granted and Respondent Cheryl R. Brawley’s request to resign in lieu of discipline isgranted.

On August 5, 2014, the Office of Disciplinary Counsel (ODC) petitioned to transfer Respondent James H. Fosbinder to inactive status, due to a mental or physical illness or disability. Insofar as disciplinary proceedings have been initiated against Respondent Fosbinder, and the instant petition was approved for filing by the Disciplinary Board Chair, we view the motion as a Disciplinary Board Petition for Removal to Inactive Status, made pursuant to Rules 2.19(b) and (c) of the Rules of the Supreme Court of the State of Hawai’i (RSCH). Petitioner nominates clinical neuropsychologist Dr. Ellen R. Caringer, Ph.D, to examine Respondent Fosbinder. Respondent Fosbinder submitted no response to the petition. Therefore,
IT IS HEREBY ORDERED that the Clerk shall re-caption the case Disciplinary Board of the Hawai’i Supreme Court v. James H. Fosbinder.
IT IS FURTHER ORDERED that Respondent Fosbinder is immediately transferred to involuntary inactive status in this jurisdiction pursuant to RSCH Rules 2.19(c), effective with the filing of this order. Respondent Fosbinder shall remain on involuntary inactive status until further order of this court.

Upon consideration of the Report and Recommendation of the Disciplinary Board of the Supreme Court of the State of Hawai’i recommending this court suspend Respondent Christopher M. Fujiyama for two years and require him to bear the cost of the disciplinary proceedings, and upon review of the record, this court reaches the following findings and conclusions by clear and convincing evidence.
Respondent Fujiyama did, in 2012, intentionally and knowingly traffic in counterfeit goods, in violation of 18 U.S.C. § 2320(a)(1), and is currently serving a three-year period of probation for that federal offense. Such conduct reflects adversely on Respondent Fujiyama’s honesty, trustworthiness, and fitness as a lawyer, and is conduct involving dishonesty, fraud, deceit or misrepresentation, in violation of Rules 8.4(b) and 8.4(c) of the Hawai’i Rules of Professional Conduct (1994). In aggravation, we find Respondent Fujiyama acted with a dishonest or selfish motive and engaged in a pattern of misconduct which injured the corporate owners of the rightful trademarks. In mitigation, we note his previously clean disciplinary record, his timely, good-faith effort at restitution, his cooperative attitude with federal investigators, his full disclosure to the Disciplinary Board, his cooperative attitude toward the disciplinary proceedings, the other penalties imposed upon him for his conduct, including a six-month home detention during nonworking hours and full payment of a $20,000.00 fine, the support he received from 19 individuals attesting to his character, and his expressions of genuine remorse. Therefore,
IT IS HEREBY ORDERED that Respondent Fujiyama is suspended from the practice of law in this jurisdiction for a period of two years, effective 30 days after the date of entry of this order, as provided by Rules 2.3(a)(2), 2.13(d), and 2.16(c) of the Rules of the Supreme Court of the State of Hawai’i (RSCH).
IT IS FURTHER ORDERED that, in addition to any other requirements for reinstatement imposed by the Rules of the Supreme Court of the State of Hawai’i, Respondent Fujiyama shall pay all costs of these proceedings as approved upon the timely submission of a bill of costs, as prescribed by RSCH Rule 2.3(c).

IT IS HEREBY ORDERED, pursuant to RSCH 2.14, that the petition is granted and Respondent Eadean M. Buffington’s request to resign in lieu of discipline is granted.

Upon consideration of the Office of Disciplinary Counsel’s May 2, 2014 petition for issuance of a reciprocal discipline notice to Respondent Leslie Clarke Rountree II, pursuant to Rule 2.15(b) of the Rules of the Supreme Court of the State of Hawai’i (RSCH), the memorandum, affidavit, and exhibits appended thereto, the May 8, 2014 Notice of Reciprocal Discipline issued by this court, and the record, it appears that, on December 3, 2013, the Supreme Court of California disbarred Respondent Rountree for failing to provide competent representation, failing in one instance to provide any service of value to his client, failing to properly supervise his employees, willfully failing to return unearned fees, willfully sharing a legal fee with non-lawyers, commingling his personal funds with client funds in his trust account, willfully failing to maintain client fundsin a trust account and engaging in an act of moral turpitude by misappropriating for his own use and benefit settlement funds owed to a third party, which, if committed in this jurisdiction, would represent violations of HRPC Rules 1.3, 1.15(a), 1.15(c), 1.15(d), 5.3(b), 5.4(a), and 8.4(c). It further appears that this court’s May 8, 2014 Notice of Reciprocal Discipline was served on Respondent Rountree on May 15, 2014 and, by the terms of the May 8, 2014 order, RSCH Rule 2.15(b), and Rule 6(a) of the Hawai’i Rules of Civil Procedure, Respondent Rountree had until June 16, 2014 to respond to the Notice with any reasons as to why reciprocal discipline should not be imposed upon him. Respondent Rountree has failed to respond and a review of the record and precedent demonstrates, pursuant to RSCH Rules 2.15(c) and (d), that reciprocal discipline is authorized and justified. YOU ARE HEREBY NOTIFIED that the Child Support Enforcement Agency, State of Hawaii (CSEA), has filed a Complaint for Establishment of Paternity in the Family Court of the First Circuit, State of Hawaii, which involves you.  This action is to determine the father and child relationship or legal paternity, of the child(ren) named in the Complaint.  It also addresses the related issues of custody, visitation, current child support, past child support, birth related medical expenses, medical insurance coverage, and birth certificate changes for the child(ren) named in the Complaint.
YOU ARE HEREBY SUMMONED to appear in the courtroom of the Honorable Presiding Judge on Friday, September 5, 2014 at 1:30 p.m. in the Family Court of the First Circuit, State of Hawaii.  The Family Court is located at 4675 Kapolei Parkway, Kapolei, HI 96707.  You must also file an answer or other pleading and to serve it before this day on CSEA’s attorneys at the Family Support Unit, Family Law Division, State of Hawaii, at 680 Iwilei Rd., Ste. 400, Honolulu, Hawaii 96817.  If you fail to do so, a Judgment of Paternity by default will be entered against you for the relief demanded in the Complaint for Establishment of Paternity.
